The Situation:
Our client, a young man in his twenties, was pulled over late at night on a routine traffic stop. Officers claimed they smelled marijuana and conducted a search without a warrant or clear probable cause. During the search, they allegedly found narcotics in the backseat and charged our client with possession with intent to sell—a Category B felony punishable by up to 6 years in prison.
Our Strategy:
From the outset, we focused on the search itself. We obtained bodycam and dashcam footage that contradicted the officers’ justification for the stop and revealed inconsistencies in the arrest report. Our team filed a motion to suppress evidence, arguing that the search violated the client’s Fourth Amendment rights.
The Result:
The court agreed that the search was unlawful. The judge granted our suppression motion, leaving the prosecution without key evidence. All charges were dropped before trial. Our client walked away with no conviction, no fines, and no criminal record.
